Brockenhurst Claims Update: Key Developments and Upcoming Decisions

The UK Supreme Court’s decision on hospital car parking charges is imminent. Keep up to date with progress on the case...

8 August 2025

In late July 2025, our Tax team delivered a comprehensive webinar to keep financial clients informed about the latest developments in their Brockenhurst claims – a case that has significant implications for NHS organisations across the UK.

Nearly a decade of litigation

Liaison Financial has been at the forefront of this complex VAT dispute since 2016, challenging HMRC’s position on hospital car parking charges through the landmark Northumbria Healthcare NHSFT case.

After years of legal proceedings, we achieved a decisive victory at the start of 2024 when the Court of Appeal delivered an unequivocal judgment in Northumbria’s favour.

This pivotal ruling confirmed that VAT should not be charged on hospital car parking when provided by NHS trusts.

Supreme Court decision pending

HMRC has sought permission to appeal this judgment to the Supreme Court, with their decision expected imminently.

Given the potential impact of this final determination, our webinar was designed to ensure clients with outstanding claims have complete visibility of all possible outcomes and can make well-informed strategic decisions.

Commitment to client empowerment

Kenny Lee, Liaison Financial’s Head of Tax Services, emphasised Liaison Financial’s dedication to keeping clients fully informed:

We’re pleased to offer webinars such as this, making sure our clients are empowered with the information they need ahead of the Supreme Courts decision. This has been an important case for us over almost a decade, and we want to ensure our clients are as well-informed as possible for the final decision.
